Terms governing use of the SSIT AI Kit API, customer portal, and digital services provided by System Solve IT.
Agreement
These Terms & Conditions (“Terms”) govern your access to and use of the SSIT AI Kit Service (the “Service”), including any website, API, portal, documentation, and related digital content provided by System Solve IT (“SSIT”, “we”). By registering, accessing the API, or using the portal, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
Description of the Service
The Service provides a hosted multi-tenant API layer (for example chat, generation, optional fine-tuning workflows), customer account management, API keys with configurable scopes, usage metering (including abstract token credits and request limits), and operator administration tools. Features depend on your plan and server configuration. The Service does not guarantee availability of any specific large language model or third-party system (such as Ollama); those components may be operated by you or your host.
Accounts and API keys
You are responsible for maintaining the confidentiality of credentials and API keys. You must not share keys in public repositories or client-side code in production without appropriate protection. You are liable for activity under your keys unless you demonstrate unauthorized access despite reasonable safeguards.
We may suspend or revoke access if we reasonably believe there is a security risk, breach of these Terms, or non-payment where applicable.
Acceptable use
You will not use the Service to violate applicable law, infringe intellectual property, distribute malware, harass others, or attempt to gain unauthorized access to our systems or other tenants’ data.
You will not probe, scan, or test the vulnerability of the Service without prior written authorization, except as part of an agreed penetration test.
You will comply with export control and sanctions laws. You will not use the Service for illegal surveillance or to generate unlawful content where prohibited.
Usage limits and metering
Usage is subject to your plan’s limits (including abstract token credits per billing period, optional daily caps on trial keys, and fine-tuning operation costs where enabled). Metering is based on server-side records. If you exceed limits, we may throttle or reject requests until you upgrade, purchase additional capacity where offered, or the next period begins.
Published marketing or plan descriptions are informational; if your workspace was provisioned with different limits, those limits in the portal or contract prevail.
Intellectual property
SSIT and its licensors retain all rights in the Service, software, documentation, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business or personal purposes in accordance with your plan.
You retain rights to your inputs and outputs, subject to applicable law and any third-party model licenses. You grant us a limited license to process your data solely to provide the Service.
Third-party services
The Service may interoperate with third-party models, hosting, or payment processors. Your use of those services may be subject to additional terms. We are not responsible for third-party failures beyond our reasonable control.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUTS MAY BE INACCURATE OR INCOMPLETE; YOU ARE RESPONSIBLE FOR VALIDATING OUTPUTS FOR YOUR USE CASE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SSIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS (US$100), EXCEPT WHERE PROHIBITED BY LAW.
Indemnity
You will defend and indemnify SSIT and its affiliates against claims arising from your use of the Service, your content, or your violation of these Terms or applicable law.
Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or non-payment. Provisions that by their nature should survive (limitations, indemnity, governing law) will survive termination.
Governing law
Unless otherwise agreed in writing, these Terms are governed by the laws applicable to System Solve IT’s place of establishment, without regard to conflict-of-law rules. Courts in that jurisdiction shall have exclusive jurisdiction, except where consumer protection law requires otherwise.
